Disclaimer: Some of these states were rather vague in the way they addressed the specific issue of tax sale overages (and several states had different versions of similar rules). We do our best to give the correct answers for each state above but We Would recommend that you verify this information for yourself before proceeding with the assumption that We are 100% correct. Remember, We are not a Law Firm or a CPA and We are not trying to give out professional legal or tax advice. Talk to your attorney or CPA before you act on of this information.

When and Why is this a Legitimate Fundraising Strategy?

It is impossible for us to make a blanket statement that this type of service IS or IS NOT a valid fundraising opportunity. The fact of the matter is there are thousands of auctions all around the country every year. At many of these auctions, hundreds (or even thousands) of investors will show up, get into a bidding war over many of the properties and drive prices WAY higher than they should be (note: this is part of why We have never been a huge fan of tax sale auctions). However, The Higher These Bidders Drive The Auction Final Sales Price Up On The Properties, The Larger The Overage/Over Payment Refund Will Be To The Past Property Owner. Our Goal Is To Make Sure They (THE PAST PROPERTY OWNER) Receive This Refund.

NOTE*Certain Limitations Apply, All States Have Their Own Individual Time Allotted For Past Owner To Recover Overage/Over Payment Refund Deadlines, Some Up To 3 and 4-Years In Time-Length. If Funds Are Not Claimed Within Required Time-Frame They Are Forfeited Via A Legal Escheatment Process.
